the defendant in Hausa language, the defendant
pleaded not guilty to the charge. Consequent upon the
plea of not guilty of the defendant, the case was
adjourned for hearing to enable the prosecution call
their witnesses in proof of the allegation against the
defendant.
The charge with which the defendant was arraigned
before this court and to which the defendant pleaded
not guilty, is hereby reproduced below as follows:“That you Bilal Ibrahim of Kofar Atiku Area,
Sokoto on or about 31st March, 2020, at about
1100hrs at Kwamberu junction, Kofar Atiku
Area, Sokoto South Local Government Area of
Sokoto State within the Sokoto Judicial
Division did commit the offence of Culpable
Homicide not punishable with death in that as
a result of your misunderstanding with one
Ahmed Abubakar (now deceased) you stabbed
him with a knife on his stomach and the back
of his body in retaliation of the first stab you
receive from him as a result of which he fell
down in full of his blood and was later rushed
to Usman Danfodiyo University Teaching
Hospital, Sokoto where he was confirmed
dead, an act which you knew was likely to
cause his death and you thereby committed an
offence punishable under Section 192 (2) of the
Penal Code.”
In their efforts to prove the charge against the
defendant, the prosecution called 3 witnesses and
tendered 2 exhibits marked as Exhibits B and B1
which are the Hausa and English translated versions
of the defendant’s extra-judicial statement. Exhibit A
is the extra-judicial statement of PW1 which was
