Yakubu Sani Esq: You said you recorded the statement of the 1st
Defendant which you also translated into English?
PW2:
Yes, and if I see the statement I can identify it
through my handwriting, date 20/12/2018 and my
signature.
Yakubu Sani Esq: Have a look at the statement and tell the court if it is
the statement.
PW2:
That is the statement.
Yakubu Sani Esw: The witness having identified the statement of the
1st Defendant, we seek to tender same in evidence.
Abdullateef Akangbe Esq: We have objection in two fold. The first is
that the statement was not made voluntarily. The
second ground is that the statement sought to be
tendered was not signed by the 1st Defendant
particularly the Hausa version but we will address the
court during our final address.
Yakubu Sani Esq: The statement is relevant to the fact in issue and
therefore admissible and urge the court to admit same
on ground of relevancy. We are changing our position
and we apply to withdraw it.
Court:
The statement been relevant to the fact in issue and
the prosecuting counsel having replied to the
objection, cannot withdraw it and on grounds of
relevancy, same is hereby admitted in evidence and
marked as Exhibit ‘E’ and ‘E1’ for Hausa and
English translated versions respectively.
