The prosecution from their adopted written address, formulated only
one (1) issue for determination and is hereby reproduced below as
follows:“Whether from the totality of the evidence
adduced before this court, the prosecution
can be used to have proven its case against
the Defendants beyond reasonable doubt.”
For the purpose of this Judgment, I have decided to adopt the sole
issue as formulated by the prosecution as the issue so formulated will
also conveniently address all the three (3) issues formulated by the
defence counsel. That is:“Whether from the totality of the evidence
adduced before this court, the prosecution
has proved its case beyond reasonable
doubt against the Defendants.”
The case of the prosecution against the Defendants in respect of the
three (3) counts charges, is as presented, by the evidence of the six (6)
prosecution witnesses and the twelve (12) exhibits tendered by the
prosecution.
