Y.K. Saidu Esq: The defendant has approached the prosecution with
a plea bargain agreement which the prosecution
accepted on the understanding that the defendant
will restitute the N115,000 in three {3} installment;
that he be given option of fine N20,00 and in default,
one {1} imprisonment. the plea bargain agreement
was filed on the 23/1/2023.
M.J. Audu Esq: It is true that a plea bargain agreement was reached
between the defendant and the prosecution in which
the terms were reduced in to writing.
SENTENCE
Court:
In consideration of the provisions 169 of the ACJL
of Sokoto State 2019, and the plea bargain agreement
entered by the defendant and the prosecution which
was reduced into writing and filed on the 23/1/2024,
I hereby find you Jesse Osazuwa Ailabojie guilty of
the offence of Criminal Breach of Trust punishable
under section 301 of the Sokoto state penal code law
2019 and sentence you to a fine of N20,000 or 1 year
imprisonment in default. The convict is also
adjudged to make a restitution of the N115,000 to the
victim of the crime as agreed in 3 installments. The
sentence takes effect from today.
