“273. Whoever kidnaps or abducts any person shall be
punished with imprisonment for a term which may
extend to fourteen years and shall also be liable to fine.”
“272. Whoever by force compels or by any deceitful
means induces any person to go from any place, is said to
abduct that person.”
“85. Whoever abets any offence shall if the act abetted
is committed in consequences of the abetment and no
express provision is made by this penal code or by any
other law for the time being in force for the punishment
of such abetment, be punished with the punishment
provided for the offence.”
Section 3 of the Robbery and Firearms {special provisions}
Act Cap. R11 LFN 2004 particularly subsection (1) of the said
section provides as follows:“3 (1) Any person having a firearm in his possession or
under his control in contravention of the firearms Act or
any order made thereunder, shall be guilty of an offence
under this Act and shall upon conviction be sentenced to a
fine of twenty thousand naira or to imprisonment of not
less than ten years or both.”
Court:
During the trial, prosecution tender eight {8} exhibits which
were admitted in evidence and marked as exhibits A, B, C, C1,
D, D1, E and E1 respectively.
Exhibit A is the done gun. Exhibit B is the cartridge. Exhibit C
and C1, are the Hausa and English translated versions of the
