Zakariya told me each bag was bought at
the rate of N23,000 but now is N13,000 at
market price. I tell Mr. Kamiru ‘m’
Zakariya to call hajiya Saratu Ladan
Tsamiya and inform her about the recent
price if she order him to sell those goods,
he should sell. I don’t know whether he
call Hajiya or not.”
PW1 in her evidence testified to the fact that when the respondent
opened up that he sold part of the ginger and sent part of it to Malabil
in Benin Republic, she asked the respondent in surprise as to with
whose consent he sold the ginger as well as the whereabouts of the
money realized from the sale, but that the respondent did not answer
her 2 questions.
In exposing how he used part of the PW1’s money to buy Zobo
without her authorization, the respondent in his extra-judicial
statement admitted as exhibit A and A1, sated as follows:“--- I bought Roselle {Zobo} and stored it.
But honestly I did not inform Hajiya
before I purchased the Zobo even Moh’d
was not informed.”
Form the foregoing pieces of evidence before the trial court it has
become apparent that there is no evidence before the trial court that the
respondent was in fact authorized to dispose up the ginger at that
lower price when he sold the ginger, and there is also no evidence
before the trial court that the respondent was authorized by PW1 to
use part of her N8,000,000:00k to by Sobo as did by the respondent.
