CHARGE “That you Muhammadu Dan Meri (m) on or about the 25th of Sept. 2019 at about 1600hrs while returning from Kusu Village of Dange Shuni LGA of Sokoto State within the Sokoto Judicial Division, did commit the offence of Culpable Homicide punishable with death in that while armed with sticks and canes along others at large between Kusu and Bela Villages of Dange Shuni LGA of Sokoto State you attacked one Abubakar Auwalu (Deceased) of Bela Village and inflicted serious injuries on his head which resulted to his death shortly while on admission at Specialist Hospital Sokoto with the knowledge that death would be the probable consequence of your act and you thereby committed an offence punishable under Section 191 of the Penal Code Laws of Sokoto State 2019”. The charge was read, interpreted and explained to the defendant in Hausa Language and he pleaded not guilty to the said charge. In a bid to prove the charge against the defendant, the prosecution called a total number of 6 witnesses and tendered 3 exhibits, exhibit A, A1 and B respectively. The defendant Muhammadu Danmeri testified in his own defence as DW1 and did not called further evidence. The first witness that testified for the prosecution in this case is one Sgt.
