and an aged mother who solely relied on him for their survival and upkeep. If the convict is given another chance he would be of use to himself and the society. We therefore urged the Court to temper justice with mercy in given the convict a lesser punishment as provided by the law creating the offence. Umar: No objection. SENTENCE I have listened to the learned defence counsel pleading for leniency on behalf of the convict. I will consider the points raised by the learned counsel and will be lenient in passing the sentence against the convict. I will consider the law prescribing the punishment for the offence and pass the minimum sentence provided by the law. It is to be noted that Section 194 of the Penal Code provides as follows “Whoever commits Culpable Homicide not punishable with death shall be punished with imprisonment for a term of not less than 14years and not exceeding Twenty one years (20years) or with life imprisonment”. It is to be noted that by the provisions of Section 194 of the Penal Code, this Court is given the discretion to pass either the minimum term of imprisonment of 14years or a maximum of 21years or to pass life imprisonment. In this case I will take the first option. Therefore you Muhammadu Danmeri having been convicted of the offence of Culpable Homicide not punishable with death contrary to Section 192(4) of the Penal Code and punishable under Section 194 of the same I hereby convict you to serve a sentence of 14years imprisonment. The sentence to commence from the date you were arrested. 21
