CHARGE That you Wadata Dan-Umma “M” of Inname village of Binji Local Government area of sokoto state, on or about 8th day of August, 2020 at Inname Village Binji Local Government Area of sokoto state, within sokoto judicial division did commit the offence of rape in that you attacked one Maryam Umar (F) 10 years of age, while coming from the bush after getting grasses, pulled her down, removed her wrapper, removed your trouser and forcefully had sexual intercourse with her against her will and thereby committed an offence punishable under section 260 of the penal code law of sokoto state of Nigeria 2019. The charge as amended was read to the hearing of the defendant and he pleaded not guilty to the charge frame against him by the prosecution in this case. In a bid to secure a conviction, the prosecution called five witnesses who testified as PW1, PW2, PW3, PW4 and PW5 respectively, and equally tendered several Exhibits namely: (1) Exhibit A and A1:- statement of the defendant (2) Exhibit B:- Medical report After the close of the prosecution’s case, the defendant testified in his defence as DW1 the sole witness for the defence and close his case on 11th/1/2024.
