Conspiracy and Unnatural Offence punishable under Sections 97 (1) and 284 of the Penal Code respectively, and the said Sections are hereby reproduced as follows:“97(1) whoever is a party to a Criminal Conspiracy to commit an offence punishable with death or with imprisonment shall where no express provision is made in this Penal Code for the punishment of such a conspiracy, be punished in the same as if he had abetted such offence. 284. Whoever has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for a term which may extend to fourteen years and shall also be liable to fine.” As to the 1st count charge of the offence of Criminal Conspiracy contrary to Section 97 (1) of the Penal Code, Section 96 (1) of the Penal code Law Cap. 104 Laws of Sokoto State 1996, when two or more persons agree to do or cause to be done:(a) an illegal act; or (b) an act which is not illegal by illegal means, such an agreement is called a Criminal Conspiracy. - Salawu V.
