fundamental rights guaranteed under Sections 34 & 35 of the Constitution of Federal Republic of Nigeria 1999 and Articles 4, 5, 6 and 12 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act Cap. 10 Laws of the Federation of Nigeria, 2004. B. A declaration that the continued detention, confinement and incarceration of the Applicant since August, 2020 by the Respondents, their agents, servants, privies, officers or otherwise howsoever without bringing the Applicant before a court of competent jurisdiction or to answer any charge under any law, is a clear violation of the Applicant’s Fundamental Human Rights guaranteed under Sections 33, 34, 35, 36 and 46 (1) of the Constitution of the Federal Republic of Nigeria 1999 and Articles 4, 5, 6 & 12 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act Laws of the Federation of Nigeria, 2004 and is therefore illegal, unconstitutional, null and void. C. An order directing the Respondents whether by themselves, their servants, agents, officers or otherwise howsoever to forthwith release the Applicant from Custody and to issue him with a written apology for his wrongful detention. D. An injunction restraining the Respondents whether by themselves, their servants, agents, officers or otherwise howsoever from applying for a remand order or further remand order against the Applicant in respect of the allegation of Criminal offence to which the Applicant has been in detention since August, 2020.
