Homicide not punishable with death, nor define what constitute Culpable Homicide. For the purpose of what is Culpable Homicide under the Sokoto State Penal Code Law, 2019 and the prescribed punishment for Culpable Homicide not punishable with death, Sections 190 and 194 of the said Code, provide as follows:“190. Whoever causes death (a) by doing an act with the intention of causing death or such bodily injury as is likely to cause death; or (b) by doing an act with the knowledge that is likely by such act to cause death; or (c) by doing a rash or negligent act, commits the offence of Culpable Homicide. 194. Whoever commits Culpable Homicide not punishable with death, shall be punished with imprison for a term of not less than fourteen years and not exceeding twenty one years or with life imprisonment.” From the provisions of Section 190 of the Sokoto State Penal Code Law, 2019 which defined what constitute Culpable Homicide, it follows therefore that the prosecution is required to prove the following elements:(i) that death of a human being has occurred; (ii) that the death was caused by the act of the defendant and Page 10 of 34
