From the earlier quoted portion of the defendant’s extrajudicial statement admitted in evidence and marked as
Exhibit A1, it is very clear that there was robbery incident
that took place along Birnin Kebbi road, robbers who
included the defendant, were not armed with any dangerous
weapons. It was also apparent that during the robbery
incident, PW1 (Faruk Liman Ambursa) was dispossessed of
his motorcycle Bajaj.
The defendant’s statement was corroborated by the evidence
of PW1 under cross examination who testified to the fact that
at the CID Office, Sokoto, the defendant in his presence,
confessed to the Police about his participation in the robbery
and also informed the Police that he had already sold the
motorcycle at Kasuwar Daji in Zamfara State.
PW2 Mudassir Abdullahi also testified in corroboration to
the confession of the defendant and the evidence of PW1,
that the defendant while at CID his presence, confess his
participation in the commission of the robbery against their
victim (PW1). It was also his evidence that he observed that
PW1’s face had swollen as well as had wounds on his hands.
The foregoing pieces of evidence of PW1 and PW2 having
corroborated the confessional statement of the defendant
making the confession consistent with the fact of case
showing that the defendant had the opportunity to commit
the offence, defendant’s retraction of the confessional
statement during his testimony as DW1, is inconsequential
and is hereby discountenanced.
