Fahad and got hold of the 3rd Defendant and in the process, the 3rd Defendant inflicted matchet cut on my right shoulder with a cutlass. When the 2nd Defendant realized we have overpowered them, he requested the remaining 2 to leave, and in the process of leaving, Fahad succeeded in inflicting injury on the 1st Defendant.” The evidence in chief of the 1st Defendant as DW1, substantially confirmed or corroborated the evidence of PW4 quoted above. Under cross examination, the 1st Defendant as DW1 confirmed their visit at Sama Road where the incident happened and the injury he sustained where he testified as follows:“…even where we stopped to buy soya beans, we are on a motorcycle. The 3rd Defendant was in the middle while the 2nd Defendant was the one driving the motorcycle. It was 2nd and 3rd Defendants that took me to hospital.” Furthermore, under cross examination, PW3 one Inspector Rabiu Garba testified before this court that it was the 1st Defendant who after he was arrested at Specialist Hospital Sokoto while receiving treatment from the injury he sustained during the incident, that acted as a pointer to the Investigating Police Officers of his co-accused persons which led to the arrest of the 2nd and 3rd Defendants. In the light of the forgoing case laws authorities coupled with the foregoing pieces of evidence against the 3 Defendants with respect to the offence of Criminal Conspiracy, evidence of some community efforts on the part of all the 3 Defendants aimed at committing a crime Page 14 of 27
