Ovia Esq: You’re aware that the defendant was attacked and injured leading to his hospitalization? PW3: I am not aware. S. Ovia Esq: Are you aware that the defendant was taken to hospital? PW3: Yes I am aware that the defendant was taken to hospital. S. Ovia Esq: During your investigation, did you see the hospital card of the defendant? PW3: I can’t remember and I cannot identify the card. S. Ovia Esq: We apply that the hospital card be released by the prosecution and apply to tender same from the Bar since there is no dispute. We rely on Section 1 of the Evidence Act 2011 which allow relevant facts to be admitted in evidence in any proceedings. H.S. Buhari Esq: We have no objection.
