b. Whether with the totality of evidence put forward by the defence, it will be justifiable to convict the Defendants on the allegation in charge preferred against them in this court. Learned counsel while arguing the above maintained that a critically looking at the testimonies of PW1, PW2, PW3, PW4, PW5 and PW6 the court will notice that the prosecution has failed woefully to prove the ingredients of the offence charge and therefore court was urge to discharge and acquit the Defendants. The Prosecution on its part, formulated a sole issue for determination to wit, whether from the quatum of evidence adduced by the prosecution, It could be that it has discharged the burden on it by proving the offences for which the Defendants are charged beyond reasonable doubt.
