defendant. DW1 in his testimony before this court stated that he knew that the defendant has mental problem and that there was a time he was admitted at Federal Neuro Psychiatric hospital Kware twice in the year 2014. DW1 told this court that the hospital at Kware issued a medical report in respect of the defendant. DW1 further told this court that when he heard that the defendant was at the correctional centre Sokoto, he went to Kware and obtained the medical report in respect of the defendant and wrote a letter to the office of Hon. Attorney General of Sokoto state. The said letter to the Attorney General and the medical report were tendered in evidence through this witness and same admitted in evidence by this court as exhibits C and C1 respectively. Under cross – examination DW1 told this court that he cannot state exactly when the problem with the defendant started but that he was been sick for sometimes and that the problem started when the defendant finished primary school. DW1 also told this court that he could not state the actual date the defendant was taken to the hospital. This witness further stated that at the time the defendant committed the alledged offence he was not under his custody and that at the time the defendant committed the alledged offence he doesn’t know his 30
