preposterous to look for such evidence in other
directions….”
In Abacha V. State {supra} at page 523, Onu JSC held that
the best evidence of conspiracy is usually obtained from one
of the conspirators or from inferences.
In exhibit E1, the 3rd defendant stated as follows:“In the month of February, 2019 there was one woman
called Hajiya Maryam of Ruggar Fakko in Tambuwal LGA
Sokoto that we have ever kidnapped three of us namely;
myself, Danairi and Alhaji and took her to Kebbe bush.”
Again PW3 one Hajiya Maryam Mohammed during her evidence
in-chief testified as follows:“When I went out to verander, one of those 3 people
who came to our house, got hold of my hand and he asked
me whether I am Hajiya Maryam, and I said yes. He then
said let us go, he then forced me to follow him while the
ones were assisting him-----.”
Both PW4 and PW5 testified to the facts that during the
rescue mission of their mother PW3, they met 3 persons in
custody of their mother and identified 1st and 2nd defendants
as among the persons who abducted their mother.
The evidence of PW3 apart from corroborating the contents
of exhibit E1, also shows some community efforts on the part
of all the defendants designed to commit the offence of
abduction against PW3.
From the foregoing pieces of evidence against the defendants
in respect of the offence of conspiracy, I am in complete
