The foregoing pieces of evidence is also corroborated by the confessional statement of the defendant admitted in evidence and marked as exhibits D and D1 for the Hausa and English Translated versions respectively in which the defendant admitted going to the custom checking point where he stole some mobile phones with AK47 riffle while the custom officers were sleeping. Consequent upon the foregoing evidence, I am satisfied that the prosecution has proved the offence of theft punishable under section 287 of the Sokoto State Penal Code Law Cap. 104 Laws of Sokoto State 1996 and found you Alh. Garba Umar Alias Bukkolori guilty as charged. As to the offence of attempts to escape from lawful custody, the evidence of PW3 one ASP Aliyu Galadima shows that while he was on duty at about 8pm as charge room officer of the State CID office Sokoto, the defendant attempted to escape from lawful custody by breaking the padlock of the cell where the defendant was detained and jumping out of the cell through the window of the family unit of the State CID with a view to escape. It was also his evidence that after the defendant jumped out, they were able to rearrests him together with one Insp. Yusuf Sani and others and thereafter handcuffed the defendant. The foregoing evidence of PW3, is also corroborated by the statement of the defendant made on the 15/4/2019 which was tendered and admitted in evidence and marked as exhibit A and A1 for Hausa and English translated versions respectively wherein the defendant Page 10 of 18
