stated that he was also taken to the Hospital and was also treated there. He
also told this Court that he knew that the deceased Abubakar Lawali is dead.
Under cross-examination, he old this Court that he was also hit with a
stick and he fell down unconscious but that before he was attacked he saw
when the deceased was attacked with a stick and fell down unconscious. This
witness further stated that he don’t know when the deceased was taken to
the Hospital because he too was later attacked and was unconscious. This
witness further told this Court that the deceased died in his presence at the
Hospital. This witness further told this Court that he gave his statement to the
police at the C.I.D. office and stated that what he told the police was what he
told this Court in his evidence before the Court. At this juncture, the Learned
Defence Counsel Mrs. S. Ovie sought to tender the statement of the witness
which he made at the C.I.D. office. The said statement was admitted in
evidence without any objection by the prosecution as exhibit B.
After the close of the case by the prosecution, the defence opens their
case. The defendant testified in his own defence as DW1 but did not call any
further evidence. The defendant testified as DW1. In his evidence before this
Honourable Court, he stated that he lives at Kusu Village in Dange Shuni LGA
of Sokoto State. This witness denied committing the offence allege against
him and further stated that on the 25th of Sept. 2019 on a Wednesday, he and
his friends went to a Local Wrestling Match. He mentioned the names of
Aliyu Umar, Zayyanu and Abubakar as the other group of people they
were together with and from his side he mentioned the names of himself,
Abdullahi Jabbi and Umma Danmanga. This witness further told this
Court that on their way back from the said wrestling match they met the
