On the whole I resolve the sole issue in favour of the Applicant and against the respondent. This court having held that the charge No. SS/34c/2021 against the Applicant did not come before the court initiated by due process of law thereby robbing the court of its jurisdiction to continue with the trial of the Applicant, charge No. SS/34c/2021 is hereby struck out and the Applicant is hereby discharged.
