Consequent upon the foregoing, I resolve the sole issue formulated in
favour of the prosecution and against the defendants.
Accordingly, the prosecution having proved its case beyond reasonable
doubt against all the defendants in respect of the said offences, I hereby
find you guilty and convict you Mustapha Muhammed and Abubakar
Mustapha as charged.
ALLOCUTUS
L.O. Akangbe Esq with C.B. Sarkin Noma Esq: I plead with this court
to temper justice with mercy since the subject of
robbery has been recovered and released to the victim
by being lenient to the convicts by given them lighter
sentence. They are sober now and they can use their
lives more profitable. The convicts are first time
offenders.
Munira Ibrahim PSC: We are not objecting to the plea of leniency
made by the defence considering the fact that to the
best of our knowledge, the convicts are first time
offenders and have been in custody since from the 1st
day they were arrested. We therefore have no
objection to the plea of leniency.
SENTENCE
By the provisions of Section 310 (3) of the ACJL of Sokoto State,
2019, a trial court after conviction while sentencing a convict, is
required to take into consideration all aggravating and mitigating
factors or information as a guide in deciding the nature of the sentence
to be imposed against the convict.
