JUDGMENT
The ~efendant is charged with the offence of armed robbery contrary to section I
(_:2) o1 tl:e Ro~be _ry a_nd Firearms (special provisions) Act, cap 398 22 , Laws or the
1- cdcr~1t 1011s o1 N 1gcna 1990 as amended by /\ct No. 62 of 1999.
The particulars of the offence were that the defendant was alleged to haveth r~bbed
one Agatha Ezeoke of undisclosed amount of money at gun point on the 5 day of
May 2010 .
The prosecution cal led four witnesses in proof of its case . These witnesses are :

The defendant testified for himself as DW1 and called no further witness . The
defendant denied ever committing the offence .
I must state here that upon the arraignment of the defendant on the 4/7/ l 5, the
defendan't was not represented by a counsel. Mr. .I.I. Iguh and his team or lm,vyers
agreed to take the dock brief as ordered by the court.
The facts of this case are summarized as follows : PW I was a pump attendant or
sales girl at Capad Filling Station Agulu. ;\t about 7.20am on the 5/5/ 10. t,.vn boys
came with a motorcycle to buy fuel. She dispensed three liters or fuel hut they

pistol and pointed it at her. He asked her to lie down . I le collcctcd the proceeds or
her sale that morning and they sped oil. While this was going on , PW2 rode into the
scene with his own motorcycle . The boy with a gun pointed the gun al him . I le lell
