Exhibit C is the patient’s reference card of the defendant issued by Usman Danfodiyo University Teaching Hospital No. 510763 tendered by the defence counsel from the Bar with the consent of the prosecuting counsel. After the prosecution closed their case, the defence opened their defence and called one (1) witness who happened to be the defendant himself and thereafter closed their defence. After the close of the defendant’s case, the case was thereafter adjourned for adoption of counsel’s respective written addresses. On the 24/3/2022 when the matter was adjourned for adoption of written addresses of counsel, the prosecuting counsel did not file any written address despite the fact that he has been served with a copy of the defence counsel’s written address. He however urge the court to convict the defendant as charged. In her adopted written address, the defence counsel formulated 2 issues for determination and are hereby reproduced below as follows:“(a) Whether considering the facts and circumstances of this case, the prosecution has proved all the essential ingredients of the offence of Culpable Homicide not punishable by death against the accused person beyond reasonable doubt as required by law.
