In the Prosecution’s final written address adopted by Elizabeth Alabi Esq, the
following three issues for determination were formulated:
1.
Whether the Prosecution has proved its case beyond reasonable
doubt.
2.
Whether the Prosecution has proved the offence of conspiracy
against the Defendant beyond reasonable doubt.
3.
Whether the Prosecution has proved the offence of obtaining under
false pretence against the Defendant beyond reasonable doubt.
The three issues raised by the Prosecution in this case presents classical case of
proliferation of issues. Issue 1 as raised by the Prosecution is simply adequate to
determine this case, since the Prosecution’s case is formed up of the two count
charge for the offences of conspiracy and obtaining by false pretence. The issue
of whether the Prosecution has proved its case beyond reasonable doubt
therefore, invariably entails whether they have proved beyond reasonable dount
the two offences contained in the charge which the Prosecution had made to be
the second and third issues, respectively. I shall therefore proceed to determine
this case on issue 1 raise by the Prosecution, namely –
Whether the Prosecution has proved its case beyond reasonable doubt
against the Defendant.
