was the one who dropped from the
motorcycle first…and thereafter brought
out a cutlass and demanded us to release
our handsets as well as threatened to kill
whoever refused to comply. One of us in
person of Mas’ud gave him his white Vivo
handset. Then one of us in person of
Fahad jumped over and got hold of the 1st
Defendant. Then the 3rd Defendant
dropped from the motorcycle with an
intention to cut Fahad. So on seeing that,
I rushed to save Fahad and got hold of the
3rd Defendant, and in the process, the 3rd
Defendant inflicted matchet cut on my
right hand shoulder with a cutlass.”
As earlier stated in this judgment, the evidence of 1st Defendant as
DW1 in his oral evidence before this court, has substantially
corroborated the evidence of PW4 quoted above. Thus, from the
evidence of PW4 which was substantially corroborated by the oral
evidence of the 1st Defendant as DW1 and confirmed by the 2nd
Defendant as DW2, it has become apparently clear that on the
20/12/2018 at about 2245 hrs, the 3rd Defendant while armed with a
cutlass, attacked PW4 at Sama Road Sokoto while the said PW4 was
in company of others, violently dispossessed one Mas’ud of his white
Vivo handset and inflicted matchet cut on the right hand shoulder of
one Babangida Aliyu (PW4) in the process.
Consequently, it is the humble view of this Court that the evidence of
PW4 which gave the graphic details of what happened on the date of
the robbery incident, has substantially proved all the essential elements
of the offence of robbery against the 3 Defendants.
