JUDGMENT The Defendants were arraigned on a five count charge of Conspiracy, criminal breach of trust and obtaining money under False pretence, punishable under section 97(1) and 312 of the Penal Code Law cap 532, Laws of the Federation of Nigeria (Abuja) 1990 and section 1(3) of the Advance Fee Fraud and Other Fraud Related Offences Act 2006. The Defendants pleaded not guilty to all the count charge. In proof of its case, the prosecution called 6 witnesses and tendered 7 Exhibits. At the close of its case, all the three Defendants at the time opted to make No Case Submission. In its considered ruling delivered on the 15th of May, 2017, the court disagreed with the Defendants’ counsel, consequently dismissed the No CASE Submission and called upon Defendants to enter defence.
