“…at about 1300hrs in the night…I heard the voice
of my mother calling me saying the house is being
knocked, and when I woke up, I approached the
door, and when we push the door open, the armed
robbers started shooting and I was shot on my right
hand. When they entered into our room, they also
shot my wife on the stomach. After they shot her,
they turn back on me and started inflicting matchet
cuts on my head and also asked me ‘where is the
money?’. I showed them the money about N2
Million and they took them away. At that time, I
heard my wife saying ‘Jammare so you are the one,
who want to kill me’. He then took a knife and
stabbed her on her stomach. It was this Defendant
who stabbed my wife with the knife.”
Corroborating the evidence of PW1, PW2 (Barau Garba) also
testified in his evidence-in-chief as follows:“On 18/2/2019, it was a Saturday in the night, I
heard a sound of gun shot and then went and
attempted going to Alh. Umaru’s house, but I
became terrified and decided to remain in my house.
After the gun shot, I then went to the house of Alh.
Umaru and observed that he was injured on the
hand.”
From the evidence of PW1 and PW2, it is very clear that a
robbery incident did actually occurred in the house of one
Alhaji Umaru Garba (PW1) during which his money about N2
Million were carted away by the robbers. I therefore agree
with the prosecution’s submission that the prosecution by the
evidence of PW1, has proved the 1st element and I so hold.
