was the defendants before this court that abducted PW3 on
the fateful date, and I so hold.
I also agree with the submission of the prosecuting counsel
that it was the defendants that abducted PW3 and found
them guilty as charged for the offence of abduction contrary
to section 273 of the penal code law cap. 104 Laws of Sokoto
state 1996.
As to the offence of illegal possession of firearms, by the
provisions of sections 3 (1) and 11 of the Robbery and
Firearms {special provisions} Act Cap. R11 Laws of the
federation of Nigeria 2004, any person who is found in
possession or under his control any firearms and in
contravention of the provisions of the firearms Act, Laws of
the Federation of Nigeria 2004 which requires issuance of
licence, commits an offence, and upon conviction, be sentenced
to a fine of twenty thousand naira or period of not less than
ten years imprisonment, or to both.

Both PW4 and PW5 testified to the fact that the 3rd person
who was with the 1st and 2nd defendants on the date they
rescued PW, was the one who was in possession of a gun and
he fired a shot to PW4 before he threw away the gun and ran
away.
