prosecution called 6 witnesses tendered and closed its
case.
In a reserved and considered ruling delivered on the
17/8/2020, the learned
trial
Chief Magistrate
discharged the respondent for the offence of cheating
contrary to section 322 of the penal code and framed
2 charges against the respondent for the offences of
Criminal
breach
of
trust
and
Criminal
misappropriation because the trial Chief Magistrate
was satisfied that a prima facie case for the 2 offences
have been established against the respondent.
The ruling and the 2 counts charges framed against
the respondent, are at pages 33-34 of the record of
proceedings of the trial court. After the respondent
pleaded not guilty to the 2 counts charges, he
thereafter entered his defence and called 6 witnesses.
In its reserved and considered judgment which was
delivered on the 31/3/2021, the trial court discharged
and acquitted the respondent of all the 2 counts
charges. It is against that decision that the appellant
has brought this appeal.
The appellant under the hand of the Hon. Attorney
General of Sokoto State {Sulaiman Usman SAN}
issued a fiat to Chief J.E Ochidi SAN to prosecute
this appeal for and on behalf of the appellant.
