objection of the Learned Defence Counsel to their admissibility is hereby
overruled.
The second witness called by the prosecution is Malam Dogo who
testified as PW2 told this Court that it was in the night on a Wednesday while
he was at his house he heard commotion outside and when he came out he
saw his brother one Abubakar the deceased person in this case lying down
with some signs of beatings on his head and the people he met there told him
that the deceased fought with some people and the defendant, Umma
Namanga and Abdullahi Abubakar were all involved in the fight. This
witness told this Court that he reported the matter to the Civil Defence Office
and the following morning they came with their vehicle and took the deceased
to Specialist Hospital Sokoto where on arrival at the Hospital he died.
This witness stated under cross-examination that he was told that it was
the defendant that inflicted the injuries on the head of the deceased and that
he himself did not witness the incidence. It is to be noted that the evidence
on PW2 Malam Dogo is nothing but hearsay evidence.
The next witness that testified for the prosecution is one Lawali Shehu,
he told this Court that he is the biological father of the deceased and that
when the incident happened, leading to the death of the deceased, he was
not at home. It is to be noted that the evidence of PW3 is also the same with
that of PW2. They did not witness the incident leading to the death of the
deceased in this case and it was some people that narrated to them what
happened. Their evidence amounts to nothing but a hearsay evidence. PW4
Aliyu Lawali and PW5 Umma Mande in their respective testimonies before
this Honourable Court all told this Court that they were present when the
