attempt to hit him with the said stick but he dodged the beating and became frightened and ran away. This witness stated under cross-examination that he gave his statement to the police and that all what he told this Court was what he told the police in his statement to them. This witness further stated that it was in his presence when the defendant hit the deceased with a stick. The next witness that testified for the prosecution is one Umma Mande. This witness told this Court that he is from Bela Village of Dange Shuni LGA of Sokoto State. After identifying the defendant in this case, this witness further told this Court one day while coming back from a Local Wrestling Match at Runjin Kwandura on a Wednesday he was together with Aliyu the deceased in this case and some other people and the defendant too was also coming from the said Local Wrestling Match together with Umma Danmanga and Abdullahi and the defendant accosted them and said who among you is not a small boy and the deceased said he was the one who said so. This witness further stated that it was at that juncture that the defendant hit the deceased with a stick at the back of his head and the deceased fell down. This witness further stated that after the deceased fell down, the defendant also use the same stick and hit him and said to the deceased if you are not a small boy you should get up and retaliate. This witness further stated that at that juncture they ran away and Abdullahi who was together with the defendant chased them and he hit this witness with a stick and threw a stone at him.
