There are many possibilities of the likely cause of death. That the Prosecution has failed to link by Medical evidence the death of the Deceased to the act of the Defendant. The Charge is therefore bound to fail. That the act of the Defendant did not show any criminal intent. He did not have the intention of killing the Deceased. Learned Counsel to the Defence further relies on the right of private defence. She submits that the Deceased was an unknown criminal trespasser. That reasonable force is envisaged in overpowering the thief, robber or burglar. That any accident that occurred while carrying out a lawful act is not an offence. 16
