I then shouted and asked who fired a gun shot like this? They said they don’t know but at that time the defendant was not at the scene. I then asked all of them to hand over their guns to me and they did except the defendant who was not at the scene and I then counted their ammunitions and found all their ammunitions were complete because each one of them was given 30 live ammunitions and they are all complete. I then touched my touch light on the ground and saw a person lying on the ground about to die and he is one of the passengers of the vehicle. I also saw 4 empty shells of live ammunitions and I picked them and then called my DPO and informed him about what happened. Before the DPO arrived, one of the passengers and who happened to be a brother to the victim informed me that it was the defendant who was in front that killed their brother. The DPO arrived and asked about our number and I said we were 6 and when the DPO said all of us should come forward to where he was standing, the defendant was again nowhere to be found.
