were contracted to purchase were not amongst the list to be sold. PW3 denied that the N20,000,000.00 was for the 1st- 3rd Defendants work. He said that the nominal complainant and her husband did not pay the Defendants for their services. He said he was aware that the 2nd Defendant said that the properties are no longer for sale and that there are other houses for sale if the nominal complainant was interested. He stated that the bank drafts were not issued in the name of the 2nd Defendant nor was N20,000,000.00 facilitation money paid into 2nd Defendant’s account. PW3 stated that he is not aware of other properties introduced to PW1 by the 2nd Defendant. He said that the fact that the 2nd Defendant was a member of the Ad-Hoc Committee was in the other Defendants’ statement. He said that all parties agreed that the N20,000,000.00 was for processing. PW3 stated under further cross examination that he found out during his investigation that the N20,000,000.00 was paid in the account of 5th Defendant but the 4th and 5th Defendant did not partake in the transaction nor did they benefit therefrom. That the N20,000,000.00 deposited in the account of the 5th Defendant was disbursed in accordance with the instructions of the 1st Defendant. At the conclusion of evidence by the prosecution the 1st Defendant offered sworn testimony as DW1. She testified that she knows the nominal complainant as her friend from PortHarcourt where they were living. She got information about the properties for sale from Ogonwuanye and Miss. Franca Sambo who introduced her to the 3rd Defendant, Vera Johnson. DW1 testified that she subsequently met the 3rd Defendant in her office in Jabi in respect of the properties for sale. The 3rd Defendant informed the 1st Defendant that she has known someone who can do it and she then called the 2nd Defendant who she said was aware of the properties put up for sale by the Government. She stated that the 2nd Defendant sources for properties. The 1st Defendant testified that she spoke with a few family friends and some of them became interested in the properties sold by Ad-Hoc Committee.
