Under cross examination, this witness stated that he visited the scene
of the crime but did not recover any evidence there and he did not
interview any witness there that saw the defendant committing the
offence.
The next witness that testified for the prosecution is Nana
Firdausi Bello. She is 9 years old at the time she testified and
therefore a minor. She gave an unsworn testimony and prior to her
testimony this Hon. Court posed some questions to her to determine
her competency to testify as required by section 209(1) of the Evidence
Act 2011. This Hon. Court is convinced that from the answers given by
the said Nana Firdausi Bello to the questions posed to her by this
Hon. Court, she possesses sufficient intelligence and understood the
duty of speaking the truth. For instance a question was posed to her
by this court in the following terms: “What will be the consequences
when a person appeared before a court and tell lies and she answered
that such a person has committed wrong and will be cast into hell fire
by God in the hereafter”.
Therefore from the answers given by this witness to the questions
posed to her by this court, this court is satisfied that she is competent
testify before this court. As stated earlier this witness gave an
