I will first of all consider if the prosecution by the evidence adduced in this case before this court proved the essential ingredients of the offence of rape contrary to section 260 of the penal code of sokoto state 2019 before considering the defence of insanity raised by the defendant through DW1. The first ingredient to be proved is that the defendant had sexual intercourse with the victim in this case Nana Firdausi Bello. Nana Firdausi Bello a 9 year old gave an unsworn testimony before this court and in her testimony when she testified as pw3 she gave account of how the defendant took her on his shoulders in order to pluck mangoes and how he started touching her private part. Nana Firdausi Bello further narrated to this court how the defendant took her into his room, removed her panties and asked her to lay on his mattress and how he also removed his trousers and laid on her and inserted his penis into her virgina and started kissing her. Pw3 further told this court that after the defendant finished what he was doing she put her panties back and he gave her the mangoes and she went home but before going home she stated that the defendant warned her not to inform her mother of what transpired between them and if does he would kill her.
