RESOLUTION
The Appellants formulated a broad issue which encompasses the two
issues of the respondent, even though the appellant submitted that the
issues do not emanate from the grounds or judgement and that they are
more than the issues of the appellant.
I have examined these issues for
determination and grounds contained
in the notice of appeal filed on
2913122 and
I
disagree with that submission. The issues emanate from the
judgement especially the ground 1 of the notice of appeal which covers it
especially the particulars of error in 1, 2, B & 9; while ground 2, pafticulars
5 & 6 covers the two issues for determination.
I
also do not agree that two
issues are far more than the sole issue formulated by appellant
to apply
the law they are encapsulated in the Appellants sole broad issue.
In any event as earlier stated the sole issue of the appellant is sufficient for
resolution of the issues herein.
There are 10 charges against the appellant, as stated in page 151-155 of
records.
The issues at play here are; whether in convicting the defendant, the
learned trail court took into account and followed the laid down procedures
for admissibility of the exhibit p3 -confessional statement and Pl- the video
and the applicability in the judgement.
