involvements in trite crimes, we have objection to justice
being tempered with mercy.
SENTENCE
Court:
By the provisions of Section 310(3) of the ACJL of Sokoto
State 2019 after conviction while sentencing a trial court is
required to take into consideration all aggravating and
mitigating evidence or information a guide in deciding the
nature and extent of the sentence to be passed on the convict.
In passing this sentence, I have taking into consideration the
allocutus made by the defence counsel on behalf of the
convicts as well as the response of the prosecuting counsel.
By their physical appearance and the age indicated on their
respective extrajudicial statement, the convicts are no doubt
young men. I have also taken into consideration that the
convict are first term offenders with no evidence of previous
conviction. The evidence of DW1 one Umar Buba who is
also a Village Head testified as to the good character of the
convicts.
The evidence of DW4 are Abdullahi Usman a Youth Leader
of Miyetti Allah, also shows that the convicts don’t usually
involve themselves in kidnapping activities.
I have also taken into consideration that by the provision of
Section 60(2) of the Sokoto State Penal Code Law, is
punishable with imprisonment or with an option of fine.
Although there is no option of fine for the offence of
Kidnapping punishable under Section 247 (b) of the Sokoto
State Penal Code Law 2019, by the provisions of Section 510
(1) of the ACJL of Sokoto State 2019, this court has been
given the judicial discretion to impose a fine in lieu of
imprisonment and the amount to be imposed according to
Section 419 (1) of the ACJL of Sokoto 2019, is at the
