discretion of the court. Encouraging non-custodial
sentencing, Section 415 (2) (k) of the ACJL of Sokoto State
2019, is to the effect that sentencing to a term of
imprisonment shall apply to those offenders who should be
isolated from the society and with whom other forms of
imprisonment have failed or is likely to fail. Furthermore
Section 415 (2) (d) of the ACJL of Sokoto state 2019,
provides that trial court re-enjoined not to pass the maximum
sentence on a first offender. Consequently since by Section 3
of the ACJL of the Sokoto State 2019, the provisions of the
said ACJL applies to all criminal trials for offences created by
laws of the law and other offences punishable in the state, it
has became mandatory for this court to take into
consideration the provisions of the said ACJL of Sokoto State
in sentencing the convicts.
Accordingly and in consideration of all the foregoing, the
sentence of this court against yon (1) Aliyu Abdullahi and (2)
Aliyu Umar for the offences of Kidnapping punishable under
Section 247 (b) the Sokoto State Penal Code Law 2019 is 12
years imprisonment or option of fine of N100,000 each and 2
years imprisonment or N25,000 each for the offence of
Criminal Conspiracy punishable under Section 60 of the
Sokoto State Penal Code Law 2019 respectively. The
sentences are to run concurrently with effect from today.
