Nwobike’s case, the Supreme Court dealt with the
powers of the EFCC to prosecute economic crimes
which is the subject matter in this application. The
decision is very in equivocal.
On the whole, we urge the court to grant this
application because the Judgment will go a long away
in ensuring that the EFCC do the needful.
S.H. Sa’ad Esq: We are opposing the grant of the application of
Defendant/Applicant, admit doing so, we have filed a
33 paragraphs counter affidavit. We rely on all the
averments contained therein. Attached to the said
counter affidavits, are 12 exhibits marked as Exhibit 112 respectively.
We also rely on all the exhibits attached thereto.
Attached to the counter affidavit is a written address
and we humbly adopt the said written address as our
oral legal argument in urging the court to dismiss the
Applicant’s application as lacking in merit.
By way of adumbration, the counter affidavit of the
Respondent, at paragraph 47.0 the case of Nwobike
SAN, stipulated the last for ascertaining if a Criminal
conduct can be regarded as economic and finance is
crimes and since no further affidavit, we urge the court
to deem our counter affidavit as having been admitted.
